fa تحلیل حقوقی تأمین اجتماعی ایران در پرتو اصول و الگوهای نظام تأمین اجتماعی مطلوب Legal Analysis of Iran’s Social Security in Light of the Principles and Patterns of a Desirable Social Security System رفاه اجتماعی اصیل orginal مقدمه: امروزه نظام تأمین اجتماعی از مهم‌ترین سازوکارهای تحقق عدالت اجتماعی محسوب می‌شود: امری که تقریباً و تنها با اختلاف در میزان اهمیت در همه نظریه‌های دولت، از دولت لیبرال تا دولت رفاه و حتی دولتهای پسارفاهی، مشترک است. در ایران نیز  با شروع مدرنیته، دولتها اهتمام ویژه‌ای به نظام تأمین اجتماعی داشتند. نظام تأمین اجتماعی وفق مقاوله‌نامه 102 سازمان بین‌المللی کار (1952)، به منزله حمایتی است که جامعه را در قبال آسیبهای اجتماعی و اقتصادی متعهد می‌نماید تا به واسطه قطع یا کاهش شدید درآمد افراد به علت بیماری، بارداری، حوادث و بیماریهای ناشی از کار، بیکاری، از کار افتادگی، سالمندی، و فوت و نیز افزایش هزینه‌های درمان و نگهداری؛ به اعضای خود ارائه دهد. پژوهش حاضر، با دو سنجه: نخست، اصول حاکم بر تأمین اجتماعی مطلوب و استاندارد و دوم، الگوهای رایج اجرای این نظام، به روش توصیفی-تحلیلی سازمان‌دهی شده است. مرور انتقادی: برخلاف باور رایج، ساختار حقوقی تأمین اجتماعی ایران &zwj;&zwj;به لحاظ اصول لازم‌الاجرا برای یک نظام مطلوب و اثربخش، فاقد کاستی است و اصول مربوطه از جمله فراگیری، برابری، حمایت دولت، حداقل‌بودن حمایتها، جامعیت، پیشگیری، توان‌مندسازی، در حقوق موضوعه ایران جایگاه محکمی دارند. همچنین، وضع نظام موجود از منظر الگوی انتخابی نیز محل تأمل است. در این میان می‌توان به سیر تحول از الگوهای سنتی شامل پس‌انداز و الگوهای مداخله و تضمین شخص ثالث و سیر تدریجی به سوی الگوهای پیشرفته تأمین اجتماعی نظیر الگوهای مبتنی شغل و نظام های عام تأمین اجتماعی با رویکرد حقوق عمومی، اشاره کرد. بنابراین باید گفت، نظام تأمین اجتماعی ایران دست کم، از منظر انتخاب الگویی مناسب و همچنین به لحاظ سیر تحول تاریخی الگوها در گذار از سنتی به مدرن، در وضعیتی نامطلوب نیست و با نظامهای استاندارد فاصله‌ای ندارد. بحث: ره‌آورد پژوهش حاضر را می‌توان چنین خلاصه نمود که نظام حقوقی تأمین اجتماعی ایران، به مثابه نظامی که از یک سو اقتضا دارد که در راستای عدم وابستگی کامل فرد به حمایت دولت  قرار داشته باشد، و از دیگر سو می‌بایست در جهت پوشش و تعمیم حداقلی حقوق شهروندان در حوزه تأمین اجتماعی مطلوب گام بردارد؛ به‌دلیل پذیرش اصول جهانی و انتخاب الگوهای مناسب، تنها در حوزه های سیاست‌گذاری، مقررات‌گذاری و  همچنین  در عرصه اجرا با مشکلات متعددی مواجه است Introduction: Nowadays, social security system is seen as one of the most important mechanisms of social justice, which is shared by all theories of the state, from the liberal state to the welfare state, and even post-welfare states with some differences in the level of importance. In Iran, states made special attempts to create a  social security system by the beginning of modernity. The social security system, in accordance with ILO treaty 102 (1952), constitutes a commitment to society for social and economic harm to provide citizens with advantages and benefits because of income termination or serious reduction caused by illness, pregnancy, job accidents, unemployment, disability, old age, death as well as increase in the cost of treatment and maintenance.The present study by two measures: first, principles dominating desirable social security and its standards; and second, common patterns in executing this system, has a descriptive- analytical approach.   Literature review:  In contrary to common belief, legal structure of Iran’s Social Security System has no shortcoming  in terms of the imperative principles for a desirable and effective system and the relevant principles, including universality, equality, government support,  minimizing the support, comprehensiveness, prevention and empowerment have a strong foothold in Iranian subjective rules. Moreover,, the status quo can be considered  in terms of the selected pattern.
