fa مسئولیت مدنی دولت در بلایای طبیعی رفاه اجتماعی اصیل orginal <p>طرح مسأله: این مقاله در تلاش است تا با محور قرار دادن فلسفه حقوقی و سیاسی معاصر به این سوال پاسخ دهد که چگونه می‌توان دولت را ملزم به ترمیم خرابی‌های حاصل از بلایای طبیعی، یعنی حوادثی که دولت نقشی در وقوع آن‌ها ندارد، دانست. روش: نظر به این‌که موضوع مورد بررسی در این نوشته، جنبه نظری داشته است و از موضوعات فلسفه حقوقی و سیاسی به حساب می‌آید روشن است که روش مورد استفاده در تهیه این مقاله، روش صرفاً کتابخانه‌ای است که در آن با جمع‌آوری نظرات و ایده‌های متفکرین، محتوای مقاله شکل یافته است. یافته‌ها: سه نظریه «مصلحت عمومی با ایده خدمت عمومی»، نظریه «قرار داد بیمه با محتوای دو ایده پرداخت مالیات و مالکیت حقیقی افراد بر منابع ثروت» و بالاخره نظریه «تضمین مشروعیت با ایده‌های حقوق طبیعی، قرارداد اجتماعی و برابری در فرصت» می‌توانند در توجیه مسئولیت دولت مورد استناد قرار گیرند. نتایج: نظریه تضمین مشروعیت با ایده برابری در فرصت، مناسب‌ترین نظریه در توجیه مسئولیت دولت است. نظریه مصلحت عمومی به دلیل استثنایی بودن حادثه طبیعی، نظریه قرارداد بیمه به دلیل عدم امکان محاسبه سهم افراد از منابع ثروت و بالاخره ایده‌های حقوق طبیعی و قرارداد اجتماعی به دلیل توسعه زیاد دامنه حقوق انسان از استحکام کمتری برخوردارند.</p> <p>Objectives: Focusing on contemporary political and legal philosophy, this paper tries to find justification the question of “how is possible to make a state to be liable to compensate the damages caused by the natural disasters. Method: Regarding the fact that the subject of this paper is theoretical and also considered as the legal and political philosophy, it is clear that the applied method in order to writing this paper is purely library method. Therefore this paper is formed by collecting the ideas and opinions. Findings: The public good theory, the insurance contract theory and guaranteed legitimacy theory are theories that can be appealed to justify the liability of state in the natural disasters.
