fa جنبه‌های عوام‌گرای سیاست کیفری ایران در قبال فساد اقتصادی The Populist Aspects of Penal Policy of Iran against Economic Corruption رفاه اجتماعی اصیل orginal مقدمه: تدابیر و سازوکارهای به‌کار گرفته شده در کشور ما پیرامون مبارزه با فساد اقتصادی نشان‌گر آن است که عوام‌گرایی کیفری در مبارزه با این پدیده، تهدیدی غیرقابل‌انکار است. حساسیت جایگاه نظام اقتصادی و تأثیر فساد اقتصادی بر حوزه‌های اجتماعی و سیاسی در کنار پیامدهای نامطلوب عوام‌گرایی کیفری، بررسی این رویکرد در حوزه فساد اقتصادی را ضروری ساخته است. روش: روش تحقیق در این پژوهش توصیفی-تحلیلی است و در گردآوری داده‌های آن، قوانین و مقررات و سخنرانی‌ها و مذاکرات سیاست‌گذاران تقنینی و قضایی تحلیل شده‌اند تا از این طریق میزان تأثیرپذیری از عوام‌گرایی در سیاست کیفری ایران پیرامون فساد اقتصادی تبیین شود. یافته: پی‌گیری سیاست‌های کیفری عوام‌گرا در مبارزه با فساد اقتصادی سبب شده در بسیاری موارد امنیت‌گرایی بر ملاحظات اقتصادی پیشی گرفته و جرم‌انگاری و کیفرگذاری در سیاست کیفری ماهوی با اصول بنیادینی همچون اصل قانونی بودن جرایم و مجازات‌ها هم‌خوانی نداشته باشد. تشکیل یا پیش‌بینی سازمان‌ها و ساختارهای جدید مبارزه با فساد اقتصادی پس از وقوع رویدادهای مجرمانه، بدون تبیین دقیق وظایف، در بسیاری موارد واکنشی شتاب‌زده به فساد اقتصادی بوده و حتی کارایی لازم را نخواهد داشت. عدم پیش‌بینی مرجع تخصصی رسیدگی، علی‌رغم دغدغه مبارزه سریع با فساد اقتصادی و در نقطه مقابل پیش‌بینی راهکارهایی جهت رسیدگی سریع و خارج از نوبت، در کنار سیاست تشهیر مجرمان، از مصادیق عوام‌گرایی مبارزه با جرایم اقتصادی در سیاست کیفری ایران است. بی‌تردید موازین دادرسی عادلانه در چنین شرایطی، از تهدید مصون نخواهند بود. بحث: ارتباط تنگاتنگ شیوع فساد اقتصادی و کاهش مقبولیت عمومی اگرچه امری انکارناپذیر است، اما این امر به معنای کارآمدبودن تدابیر عامه‌پسند و زودبازده در کنترل مفاسد اقتصادی نیست. با توجه به این‌که بزه‌دیده نهایی مفاسد اقتصادی شهروندان هستند، ارائه برآوردهای نظام عدالت کیفری به مردم، تمایل آن‌ها به واکنش‌های سخت‌گیرانه مقطعی را کاهش خواهد داد. بهره‌گیری از نظریات کارشناسان در سیاست‌گذاری و اولویت‌بخشی به شیوه‌های پیش‌گیرانه و علمی در مبارزه با فساد اقتصادی ضمن این‌که مستلزم هماهنگی و اهتمام سیاست‌گذاران تقنینی، قضایی و اجرایی است، مانعی مهم بر سر راه عوام‌گرایی کیفری می‌باشد.a <p style="background-position: 0% 0% margin: 0in 0in 0pt text-align: justify line-height: normal vertical-align: top background-image: none background-attachment: scroll background-repeat: repeat background-size: auto background-origin: padding-box background-clip: border-box">Introduction: Measures and mechanisms applied in economic corruption in our country indicates that penal populism is an undeniable threat in fighting against this phenomenon. The sensitivity of economic system position and impact of economic corruption on social and political areas along unpleasant consequences of penal populism, is making study of this approach in economic corruption necessary. <p style="background-position: 0% 0% margin: 0in 0in 0pt text-align: justify line-height: normal background-image: none background-attachment: scroll background-repeat: repeat background-size: auto background-origin: padding-box background-clip: border-box">Method: Method of this research is descriptive analytical study and in data collection laws and regulation and also discoursing of legislative and judicial policymakers has been analyzed. So that the influence of populism on penal policy of Iran about economic corruption will be explained. <p style="background-position: 0% 0% margin: 0in 0in 0pt text-align: justify line-height: normal background-image: none background-attachment: scroll background-repeat: repeat background-size: auto background-origin: padding-box background-clip: border-box">findings: Following populist penal policy against economic corruption causes Security-Oriented surpassing economic consideration and in substantive penal policy, criminalization and determining punishment are not compatible with Basic principles such as the principle of legality of crimes and punishments. Formation or anticipating new organizations and structures to combat economic corruption after the criminal events without detailed explanation of the functions in many cases is a hasty reaction to economic corruption and it will not even work. Despite the concern about quick combat against economic corruption ,lack of predicting specialized Forums and in contrast predicting strategies for quick and out of turn hearing along the policy of disclosing identity of the offenders are instances for populism in com…bating against economic corruption in penal policy of Iran. Certainly the principles of fair trial in such circumstances would not be immune from the threat. <p style="background-position: 0% 0% margin: 0in 0in 0pt text-align: justify line-height: normal vertical-align: top background-image: none background-attachment: scroll background-repeat: repeat background-size: auto background-origin: padding-box background-clip: border-box">Discussion: Although the close association between the prevalence of economic corruption and declining popularity is undeniable, it doesn’t mean that popular and quick impact measures are efficient in controlling economic corruption.
